1. What these terms cover

1.1 These terms apply to all cooking classes, food tours, workshops and private, corporate and group experiences delivered by Otao Kitchen.

1.2 They do not apply to venue and kitchen hire, where you run your own event using our space. That is governed by the separate Venue & Kitchen Hire Agreement.

1.3 By making a booking, paying a deposit or attending a session, you accept these terms on behalf of yourself and everyone in your booking.

1.4 All prices are in Australian dollars and include GST. Fees and charges referred to in these terms are those published on our website or set out in your booking confirmation at the time of booking.

 

2. Bookings and payment — public classes

2.1 Public class bookings are confirmed on full payment at the time of booking.

2.2 Your place is not held until payment is received.

2.3 Classes run subject to minimum numbers. If a class doesn't reach the minimum, clause 7 applies.

 

3. Private, corporate and group bookings

3.1 A deposit of 50% of the total confirms your date. The deposit is credited against your total and against any cancellation fee under clause 6.

3.2 The balance is due 14 days before the event.

3.3 Festive season. For bookings between 1 November and 24 December, full payment is required at the time of booking to secure the date.

3.4 Final guest numbers and all dietary requirements are due 14 days before the event.

3.5 Your final invoice reflects the number confirmed at the 14-day point, or the number who actually attend, whichever is greater. Charges are not reduced for guests who don't turn up.

3.6 Where no valid cancellation has been received, the booking remains payable.

 

4. Bookings made through third parties

4.1 Where you booked through a reseller or gift experience platform, your booking is also subject to that platform's terms, and refunds and changes must be arranged directly with them.

4.2 We will honour a valid booking made through an authorised partner, but we cannot process refunds for payments we didn't receive.

 

5. Gift vouchers

5.1 Vouchers are valid for the period stated on the voucher and for at least the minimum period required by law.

5.2 Vouchers are transferable but not redeemable for cash.

5.3 A voucher must be presented or quoted at the time of booking. It cannot be applied after a booking is paid.

5.4 Where the value of the voucher is less than the class price, the difference is payable at booking.

 

6. Changes and cancellations by you

6.1 All change and cancellation requests must be made by email and are effective only when we confirm them. Voicemails and unconfirmed messages are not accepted.

 

Public classes 

6.2 More than 14 days before the class — one free transfer to another date or a credit valid for 12 months.

6.3 Between 7 and 14 days — transfer to another date on payment of the published change fee, subject to availability.

6.4 Less than 7 days, or non-attendance — no refund, credit or transfer of date. You may send someone else in your place at no charge, provided you tell us their name and any dietary requirements before the class starts.

6.5 We may waive these conditions at our discretion in cases of illness, bereavement or other exceptional circumstances. We may ask for supporting evidence.

 

Private, corporate and group bookings 

6.6 Cancellation fees are a percentage of the total booking value, based on written notice received:

  • More than 28 days before the event — 30%
  • 15 to 28 days — 50%
  • 8 to 14 days — 75%
  • 7 days or less — 100%

6.7 For events between 1 November and 24 December, cancellation within 28 days incurs 75%, and within 7 days incurs 100%.

6.8 One postponement is permitted at no charge with more than 28 days written notice, to a date within 6 months, subject to availability. Inside 28 days, clause 6.6 applies.

6.9 The deposit is applied against any cancellation fee. If the fee is less than you have paid, we refund the difference within 10 business days. If it is more, we invoice the balance.

 

7. Cancellations and changes by us

7.1 We may need to cancel, reschedule or substitute a session — for example if minimum numbers aren't met, a chef is unavailable, or the venue is affected by something outside our control.

7.2 Where we cancel, you may choose a full refund, a credit, or a transfer to another date.

7.3 We may substitute a chef, a menu item or an ingredient where necessary. Where a change materially alters the experience you booked, you may transfer or receive a refund.

7.4 We'll give you as much notice as we reasonably can.

 

8. Arrival and lateness

8.1 Please arrive 10 minutes before the start time.

8.2 Classes start on time and we can't delay them for late arrivals.

8.3 If you arrive after a class has started you may join, but we can't repeat content already covered, and no refund or credit applies.

 

9. Dietary requirements and allergens

9.1 Dietary requirements must be advised at least 10 days before the class. We can't guarantee we can accommodate requests made after that, or on the day.

9.2 Our kitchen is not allergen-free. Peanuts, tree nuts, sesame, shellfish, fish sauce, soy, gluten, egg and dairy are handled and stored on site. We take care with preparation, but we cannot guarantee an allergen-free meal or environment, and cross-contact cannot be excluded.

9.3 If you or a guest has a severe allergy, please contact us before booking so you can make an informed decision. If you carry an adrenaline autoinjector, bring it and tell your chef.

9.4 You are responsible for the accuracy of the dietary information you give us, including for other people in your booking.

 

10. Age and supervision

10.1 Participants aged 16 and over may attend unaccompanied.

10.2 Participants under 16 must be accompanied by a responsible adult who stays for the whole session and supervises them.

10.3 Where a class is advertised as a children's or family program, the age range and supervision requirements published for that class apply instead.

10.4 Accompanying adults count as participants and must be included in your booking numbers.

 

11. Health, safety and conduct

11.1 Cooking involves knives, heat, hot oil and slippery floors. By attending you accept these ordinary risks and agree to follow the safety directions of our chefs at all times.

11.2 Closed-toe, flat, non-slip shoes are required. Long hair must be tied back, and loose sleeves and dangling jewellery secured or removed. We can't allow anyone into the kitchen without suitable footwear.

11.3 Tell your chef before the session about any medical condition, injury, pregnancy or mobility need that may affect your participation.

11.4 We may refuse entry to, or ask to leave, anyone who is unwell, intoxicated, behaving unsafely, or being abusive to staff or other guests. No refund applies.

11.5 Report any injury, near miss or incident to our staff immediately. We may ask for a written account for insurance purposes.

11.6 Please don't attend if you have symptoms of an infectious illness. Contact us and we'll do what we reasonably can to move your booking.

 

12. Alcohol

12.1 Alcohol is served only to participants aged 18 and over, and valid photo identification may be required.

12.2 We serve responsibly and may decline service at any time.

 

13. Photography

13.1 We may photograph or film sessions for promotional purposes.

13.2 Tell us before the session starts if you'd prefer not to appear, and we'll accommodate that.

13.3 You're welcome to take your own photos. Please be considerate of other guests.

 

14. Personal belongings

We're not responsible for loss of or damage to personal belongings brought to the venue, except where caused by our negligence. Please don't leave valuables unattended.

 

15. Liability

15.1 To the maximum extent permitted by law, our liability arising out of or in connection with your booking is limited to the amount you paid for it.

15.2 Nothing in these terms excludes liability for death or personal injury caused by our negligence.

15.3 This clause is subject to clause 16.

 

16. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a term would otherwise do so, it applies only to the extent the law permits.

 

17. Events beyond our control

17.1 Neither of us is responsible for delay or cancellation caused by events beyond reasonable control, including natural disaster, epidemic or pandemic, fire, flood, extended utility outage, industrial action, or government direction.

17.2 In that case we'll first offer to transfer your booking to an alternative date within 12 months at no additional charge, or a credit for the same period.

17.3 If no alternative date can reasonably be agreed within that period, we'll refund what you've paid, less any costs already reasonably and unavoidably incurred on your behalf, itemised for you.

 

18. Feedback and complaints

18.1 If something isn't right, please tell your chef during the session so we have a chance to fix it.

18.2 Written complaints should be sent to hello@otaokitchen.com.au within 14 days of the session. We'll respond within 7 business days.

18.3 If we can't resolve it between us, you may contact Consumer Affairs Victoria or the Victorian Civil and Administrative Tribunal. Nothing in these terms limits that right.

 

19. Privacy and communications

19.1 We handle personal information in accordance with our Privacy Policy.

19.2 We'll send you communications relating to your booking. You can unsubscribe from marketing emails at any time.

19.3 Requests to access or delete your information can be made to hello@otaokitchen.com.au.

 

20. Changes to these terms

20.1 We may update these terms from time to time. The version published on our website when you book is the version that applies to your booking.

20.2 We won't change the terms of a confirmed booking without your agreement.

 

21. Governing law

These terms are governed by the law of Victoria, and the parties submit to the jurisdiction of the courts of Victoria.
